Terms of Use

These Terms of Use ("Terms") govern your access to and use of RetroPals, a personal wellbeing reflection and goal-setting app (the "App"), provided by the developer identified in Section 14 ("we", "us", "the Developer"). By creating an account, using RetroPals as a guest, or otherwise using the App, you agree to these Terms. If you do not agree, please do not use RetroPals.

1. Acceptance of these Terms

By using RetroPals you confirm that you can form a binding contract with us, that you accept these Terms, and that you agree to comply with them. These Terms apply together with our Privacy Policy.

2. Description of the service

RetroPals lets you complete structured weekly wellbeing reflections, chat with customisable AI companions, set goals and track challenges, and review your trends through analytics. Some features (AI chat/analysis, weather, automatic health sync) are optional and can be turned on or off in Settings. Feature availability may vary slightly by platform (iOS, Android, Web), as described in-app.

3. Eligibility

You must be at least 16 years old to create an account or use RetroPals. By using the App, you represent that you meet this requirement. RetroPals is not directed at children under 16, and we do not knowingly allow their use of the App.

4. Accounts

• You may use RetroPals as a guest (anonymous account) without signing in, or create a full account via Google or Apple Sign-In.
• You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account.
• Guest accounts store data locally on-device only, and may be lost if the App is uninstalled or the device data is cleared, unless upgraded to a full account.
• You may link or unlink Google/Apple sign-in providers from Settings → Account.

5. Subscriptions, credits and payments

RetroPals offers a free tier with limited monthly AI credits, and paid plans (Premium, Premium+) with more monthly credits, plus a separate Bring Your Own AI (BYO AI) tier described in Section 6. Payments are processed via:

• Apple In-App Purchase and Google Play Billing on iOS and Android respectively, managed through RevenueCat;
• Stripe Checkout on the web app.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal, in accordance with the applicable app store's or Stripe's subscription management tools. Refunds are handled according to the policies of the Apple App Store, Google Play Store, or Stripe, as applicable to your purchase. We do not directly process refunds for purchases made through those platforms.

Credits are a virtual, in-app unit used to pay for AI usage within RetroPals. Credits:

• have no cash value outside the App and cannot be redeemed for money;
• are non-transferable between accounts;
• are consumed based on the AI model tier used for a given chat or analysis request;
• are, unless required otherwise by law or applicable store policy, non-refundable once used.

6. Bring Your Own AI (BYO AI)

Instead of purchasing credits, you may subscribe to the BYO AI tier and connect your own OpenRouter API key to power AI chat and analysis. If you use BYO AI:

• you are responsible for your own OpenRouter account, any charges billed to you by OpenRouter or your chosen model provider, and compliance with their terms of service;
• your key is encrypted and stored server-side and is used only to make AI requests on your behalf. See our Privacy Policy for details;
• you should keep your API key secure and notify us if you believe it has been compromised;
• we are not responsible for the availability, pricing, or output of models you access through your own key.

7. AI features and wellbeing disclaimer

If you are in crisis, experiencing a mental health emergency, or need medical advice, please contact emergency services or a qualified professional in your area. Do not rely on RetroPals for this purpose. We select AI models with strong safety guardrails and configure our default AI integrations to run under a Zero Data Retention policy (see Privacy Policy, Section 5), but you remain responsible for how you use and interpret AI-generated content.

8. Your content and acceptable use

You retain ownership of the reflections, notes, goals, and messages you create in RetroPals ("Your Content"). By using AI features, you grant us the limited right to process Your Content through our AI integrations solely to generate your requested response, as described in our Privacy Policy.

You agree not to use RetroPals to:

• violate any applicable law or third party's rights;
• attempt to gain unauthorised access to our systems, other users' data, or reverse-engineer the App;
• abuse, overload, or interfere with the AI systems or payment systems;
• impersonate any person or misuse another person's account or API key.

9. Intellectual property

RetroPals, including its design, branding, and underlying software, is owned by the Developer and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or source code beyond what is necessary to use the App as intended.

10. Third-party services

RetroPals relies on third-party services (including Firebase, OpenRouter and underlying AI model providers, WeatherAPI.com, Open-Meteo, RevenueCat, Stripe, Apple, and Google) to operate. We are not responsible for the availability, performance, or content of these third-party services, which are governed by their own terms.

11. Disclaimer of warranties

RetroPals is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will always be accurate.

12. Limitation of liability

To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of RetroPals. Nothing in these Terms limits any liability that cannot be limited under applicable law, including statutory consumer protection rights available to you in your jurisdiction.

13. Termination

You may stop using RetroPals and delete your account at any time via Settings → Manage Data, or by contacting us. We may suspend or terminate access to the App for violations of these Terms, or discontinue the App or specific features, with reasonable notice where practical.

14. Governing law and changes

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you may have under the law of your country of residence. We may update these Terms from time to time; continued use of RetroPals after an update constitutes acceptance of the revised Terms. We will update the "Last updated" date above when we do.
